Lingle Administration files Superferry reconsideration motion

via Derrick DePledge on Twitter
The Lingle administration filed its motion for reconsideration asking the state Supreme Court to reverse its Superferry ruling.

Here's Derrick's article in the Honolulu Advertiser.

Newspapers would do a huge service if they would share with us source documents. It would be great if the Advertiser would host and link to the argument memorandum.

"It is not fair to the Legislature (or to the Circuit Court) for this court to invalidate Act 2 because this court now suddenly prefers maverick Colorado law," wrote Dorothy Sellers, the state solicitor general, in the state's motion.

Insulting the court and claiming that the result "isn't fair" doesn't strike me as a winning formula. It's almost as though the motion has been filed purely for PR reasons, without hope of expectation of success.

I've linked to the memo in the post above. The tone doesn't strike me as one I would use in a post decision motion. Could be PR. Could be talking to the legislature too.
